چکیده
Evliliğin sona ermesiyle evlilik birliğindeki malvarlığı değerlerinin hakkaniyete uygun biçimde paylaştırılması gerekmektedir. Malvarlığı orantılı paylaştırılabilmesi için, eşlerin mal rejimi erdiğinde talep edebileceği birtakım alacak hakları bulunmaktadır. Eşler, tasfiye aşamasında, kural olarak süresince edindikleri “edinilmiş mallarının” yarısı üzerinde hakkına sahiptir. Bu hak, artık değer hesabı yapıldıktan sonra çıkan miktarın yarısını oluşturan “katılma alacağı” adlandırılmaktadır. Mal eşler taleplerini rejiminin tasfiyesinden kaynaklanan davalar ile öne sürebileceklerdir. Amaç: çalışmada, alacağının” talebine ilişkin zamanaşımı süresi ilgili öğretideki görüş ayrılıkları ve uygulamadaki son durumun incelenmesi amaçlanmıştır. Yöntem: Çalışmada tâbi olduğu süresine yönelik öğretide iki farklı ayrılığına sebebiyet veren Türk Medeni Kanunu’nun 178. maddesi Borçlar 146. maddesindeki süreleri incelenerek Yargıtay uygulamasındaki durum farklılıklarının gerekçeleri incelenmiştir. Bulgular: ermesinde süresinin gereğince 10 yıl olması gerektiği yönünde 1 mevcut ise de TBK m.146 gereği yıllık süresini kabul etmektedir.
